Terms of Service

1. Acceptance
By creating an account or using Sauna Scale (the "Service") you agree to these Terms of Service. If you don't agree, don't use the Service. The Service is provided by Cymba Labs LLC ("Cymba"), a Delaware limited liability company.
2. Service description
Sauna Scale is a software service for sauna installers. It provides AI intake on a website widget and over SMS, a configurator that produces line-item quotes, customer-facing quote views, and a lightweight CRM for managing leads.
3. Account and organization owner
You must be at least 18 and have authority to bind your business when creating an account. The user that creates an organization is the org owner and is responsible for billing, member access, and the actions taken under the org.
4. Acceptable use
You may not use the Service to send unsolicited marketing messages, harass third parties, infringe IP rights, or violate applicable law. You may not reverse engineer, resell, or sublicense the Service.
5. Customer responsibility for homeowner consent
You are the data controller for the homeowner leads that flow through your Sauna Scale workspace. You agree that you will not import phone number lists into the Service for outbound contact without prior express written consent from each contact, and you will not use the Service to send messages that would violate the TCPA, CAN-SPAM, or equivalent laws in your jurisdiction.
6. Payment and billing
Subscription fees are billed by Stripe at the rate posted on /pricing and are non-refundable except as required by law. We may change fees on at least 30 days' notice. Failure to pay may result in suspension of the account.
7. Automated messaging disclosure
Conversations on the website widget and over SMS are handled by an AI agent. We disclose this in the widget and via the consent prompt sent on first SMS contact. The AI may make mistakes; you and your team remain responsible for final quotes, scheduling commitments, and advice given to homeowners.
8. Intellectual property
The Service, including software, design, and documentation, is owned by Cymba and licensed to you for the duration of your subscription on a non-exclusive, non-transferable basis. Content you submit (lead data, branding, knowledge base entries) remains yours; you grant us a limited license to host and process it to provide the Service.
9. Termination
You may cancel at any time from your billing settings. We may terminate or suspend the Service for material breach (including non-payment, abuse, or illegal use) with reasonable notice where practical.
10. Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYMBA'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES PAID BY YOU TO CYMBA IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. CYMBA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
